These Terms of Service ("Terms") govern your access to and use of the services provided by Melon Trading Group LLC ("Company," "we," "us," or "our"), including our Discord community, website, and all related services (collectively, the "Service"). By subscribing to or using the Service, you agree to be bound by these Terms.

The Service is a subscription-based educational and informational service providing:

You should not interpret any information provided through the Service as personalized financial, investment, or trading advice. The Service provides data analysis and educational observations only. We do not provide trade execution instructions, timing directives, or recommendations to buy or sell any specific security.

2. Regulatory Status

Melon Trading Group LLC is NOT a registered investment adviser, broker-dealer, or financial institution under federal or state securities laws. We are not registered with the Securities and Exchange Commission (SEC), Financial Industry Regulatory Authority (FINRA), or any state securities regulatory authority. We do not hold any securities licenses.

We do not execute trades on your behalf, hold client funds, manage investment portfolios, or facilitate securities transactions. We are not a broker-dealer and do not act as an intermediary in any securities transaction. No fiduciary relationship exists between us and any subscriber.

3. Analyst-Provided Content Disclaimers

The Service may include trade observations, market opinions, and analysis shared by human analysts. Analyst trade ideas represent the analyst's own personal trading activity shared for educational transparency. They are NOT instructions, directives, or recommendations for you to execute any trade. We have no obligation to update, correct, modify, or retract any content, analysis, or signal provided through the Service, even if market conditions change, earlier information is proven incorrect, or an analyst changes their position. Content is provided as a snapshot in time and may become outdated immediately.

Trading securities, options, and derivatives involves substantial risk of loss. By using the Service, you acknowledge that you have read, understood, and agree to the Risk Disclosure, which is incorporated into these Terms by reference.

6. Subscription, Billing, and Auto-Renewal

6.1 Subscription Terms

The Service is offered on a monthly subscription basis at $99.00 per month.

6.2 Auto-Renewal

Your subscription will automatically renew each month until canceled. You will be charged the then-current subscription fee on each monthly anniversary of your initial subscription date. You authorize us to charge your payment method on file for all recurring subscription fees.

6.3 Billing

All payments are processed through Stripe. You are responsible for providing accurate, current, and complete payment information. If payment cannot be processed, your access may be suspended or terminated.

6.4 Cancellation

You may cancel your subscription at any time through your account dashboard or by contacting us at MelonTradingGroupLLC@gmail.com. Cancellation will take effect at the end of your current billing period.

Please refer to our Refund and Cancellation Policy, which is incorporated into these Terms by reference. In summary:

To the extent this policy conflicts with mandatory consumer protection laws in your jurisdiction, the applicable law shall prevail.

8. Access and Account

8.1 Discord Access

Upon successful payment, you will receive access to our private Discord community. You are responsible for maintaining the security of your Discord account.

8.2 Account Sharing and Redistribution

Your subscription is personal and non-transferable. You may not share your login credentials, grant others access to premium content, or redistribute any Service content. This includes but is not limited to copying, screenshotting, reselling, or repackaging 007's trade ideas or any other analyst content for distribution or sale. Violation results in immediate and permanent termination without refund.

8.3 Age Requirement

You must be at least 18 years of age to use the Service. By subscribing, you represent and warrant that you are at least 18 years old and legally permitted to enter into binding contracts in your jurisdiction. We do not knowingly provide services to minors.

8.4 Jurisdictional Compliance and Geographic Restriction

This Service is intended for residents of the United States. By subscribing, you confirm that you are a U.S. resident. You are solely responsible for ensuring that your access to and use of the Service complies with all applicable laws, regulations, and rules in your jurisdiction. The Service is not intended for distribution to, or use by, any person in any country or jurisdiction where such distribution or use would be contrary to local law or regulation.

9. Intellectual Property & Content Ownership

9.1 Ownership

All content provided through the Service — including but not limited to trade ideas, market commentary, analysis, alerts, and educational materials shared by 007 or any other analyst — is the proprietary intellectual property of Melon Trading Group LLC.

For first-time, non-egregious violations of these Terms, we may, at our discretion, provide a written warning and a reasonable opportunity (not exceeding 7 days) to cure the violation before termination. This cure period does not apply to violations of Sections 8.2 (account sharing/redistribution), 9 (intellectual property), or any conduct involving fraud, illegal activity, or threats — which result in immediate termination without warning.

We are not responsible for statements, opinions, or content posted by other users in the community. Community content does not represent our views or endorsement. You interact with other users at your own risk.

The Service relies on third-party platforms including Discord and Stripe. You acknowledge and agree that:

12.1 Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THIRTY (30) DAYS IMMEDIATELY PRECEDING THE CLAIM.

HYPOTHETICAL PERFORMANCE RESULTS HAVE MANY INHERENT LIMITATIONS, SOME OF WHICH ARE DESCRIBED BELOW. NO REPRESENTATION IS BEING MADE THAT ANY ACCOUNT WILL OR IS LIKELY TO ACHIEVE PROFITS OR LOSSES SIMILAR TO THOSE SHOWN. IN FACT, THERE ARE FREQUENTLY SHARP DIFFERENCES BETWEEN HYPOTHETICAL PERFORMANCE RESULTS AND THE ACTUAL RESULTS SUBSEQUENTLY ACHIEVED BY ANY PARTICULAR TRADING PROGRAM.

ONE OF THE LIMITATIONS OF HYPOTHETICAL PERFORMANCE RESULTS IS THAT THEY ARE GENERALLY PREPARED WITH THE BENEFIT OF HINDSIGHT. IN ADDITION, HYPOTHETICAL TRADING DOES NOT INVOLVE FINANCIAL RISK, AND NO HYPOTHETICAL TRADING RECORD CAN COMPLETELY ACCOUNT FOR THE IMPACT OF FINANCIAL RISK IN ACTUAL TRADING. THE ABILITY TO WITHSTAND LOSSES OR TO ADHERE TO A PARTICULAR TRADING PROGRAM IN SPITE OF TRADING LOSSES ARE MATERIAL POINTS WHICH CAN ALSO ADVERSELY AFFECT ACTUAL TRADING RESULTS. THERE ARE NUMEROUS OTHER FACTORS RELATED TO THE MARKETS IN GENERAL OR TO THE IMPLEMENTATION OF ANY SPECIFIC TRADING PROGRAM WHICH CANNOT BE FULLY ACCOUNTED FOR IN THE PREPARATION OF HYPOTHETICAL PERFORMANCE RESULTS AND ALL OF WHICH CAN ADVERSELY AFFECT ACTUAL TRADING RESULTS.

15. Binding Arbitration and Class Action Waiver

15.1 Agreement to Arbitrate

YOU AND THE COMPANY AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION, rather than in court, except that either party may seek equitable relief in court for infringement of intellectual property rights.

15.2 Class Action Waiver

YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.All claims must be brought in the parties' individual capacity, not as a plaintiff or class member in any purported class, collective, or representative proceeding.

15.3 Arbitration Procedure

Arbitration shall be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Loudoun County, Virginia, or at another mutually agreed location. The arbitrator's decision shall be final and binding.

15.4 Small Claims Exception

Either party may bring an individual action in small claims court if the claim qualifies.

16. Governing Law and Venue

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to conflict of law principles. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Loudoun County, Virginia.

You agree to indemnify, defend, and hold harmless Melon Trading Group LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemics, epidemics, acts of God, war, terrorism, riots, government actions or orders, power outages, internet or telecommunications failures, cyberattacks, third-party platform outages (including Discord and Stripe), or any other force majeure event. During such events, our obligations shall be suspended for the duration of the event.

19. Modifications to Terms

We may modify these Terms at any time. Material changes will be communicated at least 30 days before taking effect via email to your registered address. Your continued use of the Service after the effective date of modified Terms constitutes acceptance of those modifications. If you do not agree to the modified Terms, you may cancel your subscription before the effective date.

20. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

21. Entire Agreement

These Terms, together with the Risk Disclosure, Privacy Policy, and Refund Policy, constitute the entire agreement between you and us regarding the Service.
